Decision to Cancel Traffic Fine for Earthquake Victim

Following earthquakes centered in Kahramanmaraş, a traffic fine issued to an earthquake victim from Hatay for going to another city was canceled due to the expiration of the vehicle’s inspection period. The earthquake victim residing in Hatay, on their way from Kahramanmaraş to Bursa after the earthquakes centered in Kahramanmaraş, had their traffic fine canceled upon the initiative of the Public Ombudsman Institution. According to the amicable solution decision of the Public Ombudsman Institution, a person residing in Hatay was stopped by traffic police while on their way to Bursa with their vehicle on February 6, 2023. During the questioning, it was understood that the inspection period of the vehicle had expired, and an administrative fine was imposed on the driver. The traffic fine report dated February 27, 2023 was delivered to the driver on May 24, 2024. The driver, requesting assistance from the Public Ombudsman Institution for the cancellation of the fine, stated that the inspection period for vehicles in cities where a state of emergency (OHAL) was declared due to the earthquakes centered in Kahramanmaraş had been suspended until the end of the OHAL period in May according to the Presidential Decree published in the Official Gazette. The driver explained that they had their vehicle inspected in April 2023. The Public Ombudsman Institution, upon reviewing the application, contacted the General Directorate of Security (EGM) for a solution to the issue. In the response sent from EGM, it was stated that the location of the vehicle owner was determined to be in cities where a state of emergency had been declared, leading to the cancellation of the fine report.
