Historic Penalty for German Pharmaceutical Giant

Bayer, a German pharmaceutical company, has been sentenced to pay $2.1 billion in the Roundup case in the United States. This penalty is one of the highest compensations ever awarded to the company. The German pharmaceutical and chemical company Bayer has been ordered to pay $2.1 billion to a plaintiff in the United States due to the controversial herbicide glyphosate, which is the main ingredient in Roundup. Bayer continues to lose lawsuits brought by those claiming that Roundup, a herbicide containing glyphosate, is a significant factor in cancer formation. In court in the state of Georgia, a jury ruled on Friday that Bayer should pay the German company $2.1 billion, including a compensatory award of $65 million, to a plaintiff alleging that Roundup, a herbicide, causes cancer and other harmful effects. The jury also decided that Bayer failed to adequately disclose the potential risks of using Roundup and was responsible for not warning plaintiffs about the dangers of the product. ONE OF THE HIGHEST COMPENSATIONS The $2.1 billion amount is noted as one of the highest compensations ever awarded in lawsuits related to Roundup, a herbicide containing glyphosate, in the United States. Bayer, in a statement, denied the claims about glyphosate, stating that it disagrees with the jury’s decision because it contradicts overwhelming scientific evidence, consistency among regulatory agencies, and global scientific assessments. The company will appeal the recent decision in Georgia, as it has done with all other cases. The German company also mentioned that compensations in cases where final judgments were reached were generally reduced by 90% compared to the original jury decisions. Following this decision, Bayer’s shares plummeted by over 6% on today’s stock market. FACING 60 THOUSAND LAWSUITS After acquiring the American agriculture company Monsanto for $63 billion in 2018, Bayer faced hefty fines and compensations in lawsuits brought by those claiming that Roundup, a herbicide containing glyphosate developed by this company, is a significant factor in cancer formation. Bayer denied the allegations about glyphosate, while the International Agency for Research on Cancer (IARC) classified glyphosate as a carcinogen in 2015. In 2020, Bayer announced that it had reached agreements in lawsuits filed against it in the United States, with $10.9 billion to be paid to the plaintiffs. Despite these agreements, the company is still facing over 60,000 lawsuits related to Roundup. As a legal provision for these cases, the German company set aside $5.9 billion.
