Ali Güvenç Kiraz, President of the Real Estate Law Association, stated, “There is no upper limit for dues according to the condominium law. In some villa sites on the Bosphorus, dues are over 50-55,000 Turkish Lira.” Kiraz also mentioned, “Security guards, technical staff, gardeners, pool expenses… Dues for a residence might be 45,000 Turkish Lira, another site might charge 25,000 Turkish Lira monthly, while a regular site could receive maybe 5,000 Turkish Lira in dues.” Unpaid dues have started to be taken to court recently. It is reported that execution proceedings have increased due to dues debts. According to experts, apart from common areas, no one is obligated to pay for luxury services. In the case of unauthorized due increases, objection should be made to the general assembly. Kiraz said, “For example, if the management of a site wants to build a baby care room. For instance, a person living in the apartment or the site without being married or having children is not obliged to participate, this is a luxury expense, they may choose not to pay.” Owners who do not attend the general assembly can file a lawsuit with the conciliation court within 6 months regarding exorbitant dues.
