Scammers’ Credit Trap: Court Rules in Favor of Citizen

In recent times, the incidence of credit fraud victimization is increasing. Without citizens even being aware, loans are being taken out on their behalf through applications on their own phones. One victim took the bank to court to avoid paying the debt demanded. The court ruled in favor of the citizen. Scammers are taking out loans in other people’s names using various methods. In doing so, they utilize the applications on citizens’ phones. A person who fell victim to a loan sought justice at the Ankara Consumer Court. They filed a lawsuit against the bank demanding payment from them. They claimed that 100,000 lira was borrowed in their name and 49,437 lira was used from an additional account. The court concluded that the citizen was not liable for the debt. According to legal experts, this ruling does not set a precedent for all cases. It is stated that each case will be evaluated on its own merits. Commenting on the court’s decision, Lawyer Umut Metin stated, “If it is determined that the bank did not take necessary security precautions, the bank will have to compensate the customer’s losses. This is a commonplace, expected circumstance. In order for a ruling to become binding, it must be manifested as a Supreme Court precedent. A local decision is only valid for the parties involved in that specific case.”
