Tampering with the Scale Costed! A Fine of 482 Thousand Liras for Non-Compliance with Standards

A comprehensive law bringing new regulations to industry and commerce has been published in the Official Gazette. According to this, penalties of up to 482 thousand liras will be imposed on those who fail to comply with the standards in services, maintenance, inspections, and other activities in commerce. Violations in the repair and calibration of measuring instruments will result in fines of up to 50 liras. The Law on Some Amendments Concerning the Scientific and Technological Research Council of Turkey (TÜBİTAK) and Some Laws, published in the Official Gazette, introduces changes in the Law on the Misrepresentation in Trade and the Supervision and Protection of Exports scope, where individuals or legal entities acting contrary to the regulatory procedures related to services, inspections, maintenance, monitoring, and control activities published in the Official Gazette under the law, or non-mandatory standards for products, will face administrative fines ranging from 12,020 liras to 482,204 liras. The regulation will come into effect on March 14th.
TÜBİTAK Empowered to Grant Scholarships up to 250 Thousand Liras
Without being subject to the provisions of the Law on Scholarships and Loans to Higher Education Students based on high achievements in education and post-education, TÜBİTAK will provide scholarships to young people showing outstanding success in their learning and development. In the context of the changes made in the Law on Some Regulations Concerning TÜBİTAK, the Board of Directors will continue to make decisions on the legal settlement of disputes between TÜBİTAK and other public institutions, natural and legal persons, through legal agreements or contract revisions, but the amounts specified in the Law will change. The Board of Directors will be authorized to abandon or commence an action, execution, or similar proceedings prosecuted for material or legal reasons, to grant a right, renounce interest, decide on a suitable payment, up to the amount of 250 thousand liras. This amount will be raised each year based on the revaluation rate and will be valid from the beginning of each calendar year. These regulations will be effective on June 5th.
Fines of up to 50 Thousand Liras for Measuring Instruments
A change in the Weights and Measures Law has also come into force. Accordingly, those who act contrary to the regulatory procedures based on the Law for inspection, repair, and calibration of measurement instruments, excluding offenses under the heading “Administrative Penalties” of the Law, will be subject to administrative fines ranging from 5 thousand to 50 thousand liras.
Authority Granted to the President for TESK and TOBB Membership Dues
Amendments have been made in the Law on Incentives and Exemptions in the Small and Medium-Sized Enterprises Development and Support Administration (KOSGEB). Accordingly, the revenues of the Presidency’s budget will consist of dues to be paid in the percentages of the Turkey Tradesmen and Craftsmen Confederation (TESK) and the Turkey Chambers and Commodity Exchanges’ (TOBB) annual net income amounts. These dues can be increased up to twice by the President. This regulation will take effect on June 4th.
