Up to 5 Million Lira Fine for Health Claims that Deceive Consumers

Penalties for product promotion or sales with health claims have been increased. Accordingly, fines of up to 4.75 million lira will be imposed on health advertisements that deceive consumers.
The Ministry of Health made changes in administrative fines for those promoting and selling products with misleading health claims in line with the 2025 revaluation rates. Under the current regulations, these fines ranged from 20,000 to 300,000 lira. However, with the new regulation, the administrative fine for promoting and selling products with deceptive health claims on platforms such as social media, websites, and television channels will start at 316,724 lira. The maximum fine has been set at 4,750,319 lira.
The new penalties for product promotions and sales made with inaccurate health claims in 2025 will be as follows: “- For promotions and sales made through written and visual promotional materials such as sales points (herbalists, healthy living centers, product sales places), brochures, advertising billboards, the fines will range from 316,724 to 791,761 lira instead of 20-50 thousand lira, – For promotions and sales made through websites, local or national print media, and mobile phone messages, the fines will range from 791,761 to 1,583,462 lira instead of 50-100 thousand lira, – For promotions and sales made through local television channels, local or national radio channels, the fines will range from 1,583,462 to 2,375,188 lira instead of 100-150 thousand lira, – For promotions and sales made through national television channels, the fines will range from 2,375,188 to 4,750,319 lira instead of 150-300 thousand lira.”

According to the Regulation on Health Claim Control, health claims refer to statements that indicate, suggest, or highlight the relationship of a product or its elements with human health. All products other than medicinal products, medical devices, and special medical-purpose foods fall within the scope of health claim controls. Claims asserting the negative impact on health if not consumed, referencing the amount or percentage of weight loss or gain, using testimonials related to the experience of the person consulted about products using health claims or associating thanks, praise, recommendations, and approval expressions with national and international institutions are not allowed or implied.
